According to the provisions of the Customs Law, "smuggling of electronic products" refers to the act of transporting, carrying or mailing electronic products into or out of the country in violation of the Customs Law and relevant laws and administrative regulations, evading customs supervision, and evading the tax payable.

Article 153 of the Criminal Law and relevant judicial interpretations stipulate that smuggling electronic products with tax evasion amount of more than 100,000 yuan for individuals and more than 200,000 yuan for units, or smuggling again after having been given two administrative penalties for smuggling in one year, constitutes the crime of smuggling ordinary goods, and shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention at the minimum, and fined not less than double and not more than five times of the amount of tax evaded; and may be sentenced to fixed-term imprisonment of not less than ten years or life imprisonment at the maximum. life imprisonment, and a fine of not less than double and not more than five times the amount of tax evaded.

According to article 82 of the Customs Law, if the smuggling of electronic products does not yet constitute a crime, the Customs shall confiscate the smuggled goods and articles and the illegal proceeds, and may impose a fine; goods and articles specifically or repeatedly used as a cover for smuggling, and means of transportation specifically or repeatedly used for smuggling shall be confiscated, and special equipment for hiding smuggled goods and articles shall be ordered to be dismantled or confiscated.
